What is a Dram Shop Action?

If you’ve been injured in an accident caused by a drunk driver, we would investigate whether a Dram Shop lawsuit could be filed against the establishment where the driver became intoxicated. You can make a claim against the establishment that sold the liquor to the person who caused the injury to your client under certain circumstances.

We would have to prove there was some form of intoxication and that the defendant was at that establishment and was provided alcoholic beverages.

It is not a high threshold to prove a Dram Shop case in Illinois, but the trade-off is that a defendant in a Dram Shop case has various statutory maximums that they can be held liable for, and these statutory limits change annually.
